AGAC Project: Draft guidelines on the participation of the proposed represented person in guardianship and financial management/administration hearings

The Australian Guardianship and Administration Council (AGAC) represents member organisations which have a role in protecting adults in Australia who have a decision-making disability.  The Commonwealth government has funded AGAC to undertake a project designed to develop best practice guidelines to assist Tribunals and other decision-making bodies, to maximise the participation of the proposed represented person in guardianship and financial management/administration hearings.

The genesis for the project was a recommendation made by the Australian Law Reform Commission in its report, Elder Abuse – A National Legal Response:

The Australian Guardianship and Administration Council (AGAC) should develop best practice guidelines on how state and territory tribunals can support a person who is the subject of an application for guardianship or financial administration to participate in the determination process as far as possible.

AGAC has circulated for comment, draft guidelines and an accompanying issues paper to individuals and organisations with an interest in the issue.

The deadline for submissions is 11 January 2019.
