AGAC releases Guidelines on the participation of the proposed represented person in guardianship proceedings
On 28 July 2018, AGAC presented to the Attorney-General of Australia, The Hon. Christian Porter MP the report, Guidelines for Australian Tribunals: Maximising the participation of the Person in guardianship proceedings.
AGAC's Chair Malcolm Schyvens said: "Decisions made by Tribunals working in the guardianship jurisdiction have a profound impact on the lives of people with decision-making disabilities. The Guidelines will guide Tribunals about practical steps that can be taken, to enable people with decision-making disabilities to participate in guardianship proceedings."
"The Guidelines recognise that to give effect to the statutory obligation to have regard to the views of the Person, Tribunals must acknowledge the real difficulties in participating in Tribunals proceedings, faced by many people with decision-making disabilities."
Mr Schyvens said that the "success of the Guidelines will be measured by the extent to which they are used by Australian Tribunals to review and improve the way they conduct proceedings and involve the Person."
Over 200 individuals and organisations were invited to comment on draft guidelines developed by AGAC and released in late 2018. AGAC received 39 submissions, which are now available on AGAC's website.
